General Terms and Conditions

The Western Sydney Carpool Project is a project established by Transport for NSW and managed by the Community Carpooling Association Incorporated (CCAI).  The Project is open to individuals, employees or members of participating clubs, groups and organisations as the case may be. This website and associated mobile apps act as the window for commuters to make contact with others who may be travelling in the same direction and with whom they might share the travel.

This website and associated mobile apps are intended to be a friendly, enjoyable and useful experience but as with anything concerning any kind of transaction there are risks involved and we strongly advise you to understand all of these terms and conditions before registering and participating in any carpooling arrangement.  

CCAI's role in the program is to act as a facilitator (“Facilitator”) i.e. to implement a platform through which the community can access carpooling services.

Individuals, employees or members of participating organisations as the case may be, can register to participate in the program. We cannot and do not control whether a suitable match to carpool can be found. We do not undertake any checks on users and therefore we make no representation or warranty concerning their character or conduct.

The content of this website and associated mobile apps are provided for information purposes only. No claim is made as to its accuracy, authenticity, appropriateness or suitability for your particular needs or circumstances or for any particular use. CCAI and, its agents, instrumentalities, officers and employees accept no liability for any loss or damage caused by any error or omission contained in the information.

By using this website and associated mobile apps and/or participating in any carpooling arrangement you agree and accept that CCAI, its agents, instrumentalities, officers and employees shall have no responsibility, and do not accept any liability, for your safety or for any loss or damage you may suffer, however arising, from any transaction using this website and associated mobile apps or from participating in any carpooling arrangement. 

Our terms and conditions may be updated occasionally, at our sole discretion with or without notice to you. The most current version of the terms and conditions will always be available on the website and associated mobile apps.

Your responsibilities and conduct

It is your responsibility to comply with all laws when using this website and associated mobile apps or participating in any carpooling arrangement.

Use of the information on this website and associated mobile apps and participation in any carpooling arrangement is at your sole risk.

Those using this website and associated mobile apps or engaging in carpooling arrangements must ensure, and are responsible for, their own personal safety. CCAI, its agents, instrumentalities, officers and employees have no responsibility, and do not accept any liability, for your safety or for any loss or damage you may suffer, however arising, from any transaction using this website and associated mobile apps or from participating in any carpooling arrangement. 

Travel between your normal place of work and residence is considered personal travel. The website and associated mobile apps cannot be used to arrange work-related travel unless your employers specifically permit staff to arrange work-related travel via this website and associated mobile apps.

The use of employer provided vehicles may be subject to conditions by your employer.  It is your responsibility to ensure that you are permitted by your employer to use an employer provided vehicle to carry passengers in a carpooling arrangement.

You must not transmit through the service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any law.

You shall not make a profit from taking part in any transaction using this website and associated mobile apps or from participating in any carpooling arrangement.  Any financial transaction undertaken between any user of this website and associated mobile apps or participant in a carpooling arrangement is a personal matter and solely at their own risk.

Registration

Individuals, employees or members of participating organisations who can form a legally binding contract can register to participate in the program. Minors (persons aged under 18 years) are not permitted to register. Any person found to have registered with a false age will have his/her registration terminated immediately.

We provide you with your own login account. You may choose your own password. It is your responsibility to keep this password confidential. You accept responsibility for all activities that occur within your account. Please refer to our Privacy Policy below for further details.

Our right to suspend or terminate your registration

You agree that this website and associated mobile apps, in its own discretion, may terminate your use of the service immediately and without notice. This includes if (a) We believe that you are not abiding by the terms and conditions of this website and associated mobile apps (b) We cannot verify or authenticate the information you provide to us when you register on this website and associated mobile apps.

Images and content on this website and associated mobile apps are subject to copyright.  Copying or reproduction of the website and associated mobile apps cannot be undertaken without prior written permission.

Privacy Policy

The Western Sydney Carpool Project is managed by the CCAI. This website and associated mobile apps are maintained by the Prosentient Systems Pty Ltd, Sydney and can be updated as required.

 

We have provided hypertext links to a number of sites as a service to carpooling users. This should NOT be taken as implying any link between those various organisations or individuals, other than as stated in the terms and conditions of use. DPTI holds no responsibility for the privacy policies or practices of any third party sites linked to the Western Sydney Carpool Project website and associated mobile apps. When a user has clicked on a link to another website, they leave this site and this privacy and security statement does not apply to those websites and associated mobile apps. What personal information do we collect?

 Personal information is collected from you when you enter your details during the registration process. The minimum information we require from you if you wish to register with the Western Sydney Carpool program includes your name, email address, gender, place of work, travel preferences, regular travel origin and destination, vehicle registration number (if you intend to use the motor vehicle in any carpooling
arrangement) and travel times and confirmation that you are over the age of 18 years.  We will only collect personal information about you with your consent and for the purposes of the Western Sydney Carpool program.

What other information do we collect?

When you look at the pages on our website and associated mobile apps, information may be automatically recorded for standard statistical analysis that helps us to understand how our website and associated mobile apps are used. This collection of information does not identify individual users. For further information on the technical information collected, please email support@communitycarpooling.com.au .

Is the information stored securely?

Yes. Information collected is stored in an appropriately secure format and held by the operators of the Western Sydney Carpool program for the purpose of implementing and maintaining the program.

Use & Disclosure of Personal Information

If you register with the Western Sydney Carpool Project we will confirm your identity and your association with the club, organisation or workplace that you have nominated on the application form. Once this information is confirmed, your profile will be verified and your personal information will be used to match you with other persons who have registered on the website and associated mobile apps. Your matches will see only your travel origin and destination, gender and preferred arrival and departure times. Your name and contact details will remain hidden until both parties have agreed to contact each other to discuss travel arrangements. The preferred method of communication you nominated in registration (i.e. phone, email or SMS) will be used to determine what contact details are provided to the carpool match on linkup.  If you provided vehicle registration number/s on the carpool registration page this will also be provided to the carpool match.  If you did not provide vehicle registration information you may provide this yourself to any carpool match. It is then left to the parties to contact each other and organise the details of any carpooling arrangement between them.

From time to time, we may also contact you by email to provide you with information about the Western Sydney Carpool Project or invite you to participate in competitions or request feedback or testimonials.

The Western Sydney Carpool website and associated mobile apps usage information will be used for statistical purposes only.

We will not disclose or publish information that identifies individual computers or users except in the following circumstances:

  • unauthorised tampering or interference with files published on the Western Sydney Carpool Project website and associated mobile apps
  • unauthorised attempts to index the contents of the Western Sydney Carpool Project website and associated mobile apps by other sites
  • unauthorised attempts to access non-published files that are part of the Western Sydney Carpool Project website and associated mobile apps
  • attempts to intercept messages of other users of the Western Sydney Carpool Project website and associated mobile apps
  • where communications are made that are defamatory or abusive, that vilify individuals or groups, or which give rise to a suspicion that an offence is being committed, or
  • where attempts are made to compromise the security of the web server, breach the laws of the State of South Australia or Commonwealth of Australia, or interfere with the enjoyment of the Western Sydney Carpool Project website and associated mobile apps by other users.

The Western Sydney Carpool Project reserves the right to make disclosures to relevant authorities where it is suspected that an offence is being, or has been, committed. In the event of an investigation, CCAI will provide access to data to any appropriate law enforcement or investigative agency to inspect our records. Otherwise, we will not disclose your personal information without your consent unless permitted or required by law.

What will we do with information provided in Feedback?

The Western Sydney Carpool Project website and associated mobile apps provide online feedback facilities to allow users to provide input into the future development of the site and to comment on the Western Sydney Carpool Project. Users providing feedback may provide personal details in order to receive a reply, however, the provision of personal details when providing feedback is optional.

Personal information provided by users giving feedback will only be used for the purpose for which it was provided. It will not be provided to any other party, nor be included as new information in a mailing list.  CCAI may publish aggregated information about feedback on the website and associated mobile apps, to the extent that it does not identify or cannot be used to identify individual users.

Who else has access to information?

Access to the raw data is restricted to a limited number of officers at the Western Sydney Carpool Project for the purposes of analysis and reporting. If you would like to access information held about you by Western Sydney Carpool please email support@communitycarpooling.com.au
